The petitioner seeks pre-arrest bail in connection with Bakhtiyarpur P. S. Case No. 286 of 2014 registered under Sections 420, 467, 468, 474, 417 and 120-B/34 of the Indian Penal Code.
Considering the submission made by the learned counsel for the petitioner that initially, a complaint was filed which was referred to the police under Section 156(3) of the Code of Criminal Procedure for investigation, pursuant to which the FIR was instituted and on completion of investigation, the police submitted final report holding the accusation to be false,
Patna High Court Cr.Misc. No.18388 of 2018 (2) dt.06-04-2018 2/2 but differing with the police report, learned Magistrate took cognizance of the offence, in the event of arrest or surrender before the court below within six weeks from today, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-III at Saharsa in Bakhtiyarpur P. S. Case No. 286 of 2014, subject to the conditions as laid down under Section 438
(2) of the Code of Criminal Procedure.
