The petitioner apprehends his arrest in Bidupur P.S. Case No. 206 of 2021, registered for the offence punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2018.

95.305 litres of Indian made foreign liquor has been recovered which is allegedly thrown by six accused persons including this petitioner.

It is submitted that nothing has been recovered from conscious possession of this petitioner and he has been made accused in this case only on suspicion. Petitioner is neither driver nor owner of vehicle in question from which cartoons of liquor were thrown.

Patna High Court CR. MISC. No.25773 of 2022(2) dt.05-08-2022 2/2 Learned APP however vehemently opposed the prayer for bail and submitted that petitioner has got criminal antecedent of similar nature.

Considering the criminal antecedents of similar nature, I am not inclined to enlarge the petitioner above-named on anticipatory bail.
