ANJANA PRAKASH ORAL ORDER 20-02-2015 No one appears on behalf of the petitioner. The petitioner has sought a writ of mandamus commanding the Respondent Nos. 2 and 3 to promote the petitioner to the post of Block Agriculture Officer from October, 1982 as the petitioner had passed the examination of B.Sc. (Agriculture).

A counter affidavit has been filed on behalf of the respondent Nos. 2 and 3 wherein it has been submitted in paragraph- 6 that the petitioner had acquired the degree of B.Sc. (Agriculture) at Government cost in the year 1982. He worked as B.A.D. with effect from 18.07.1983 on ad hoc basis and superannuated on 31.01.1997. Whereas the petitioner is of 1979

Patna High Court CWJC No.16433 of 2007 (2) dt.20-02-2015 2/2 batch the persons, who were promoted were of batch 1978 and, therefore, the petitioner could not claim such right. Hence, the application is devoid of any merit and, accordingly, it is rejected.
