JUSTICE MOHIT KUMAR SHAH ORAL ORDER 06-10-2023 The present writ petition has been filed seeking the following reliefs:- "1(i). That instant WRIT application is being filed for issuance of direction to District Program officer, Motihari to pass appropriate order and take action against the respondent no.6, who has been appointed on the post of SEWIKA in panchayat Raj Kudarkat, pertaining to centre no.07/127 on the basis of forge documents and after verification of documents by the authority said fraud has been established but the D.P.O is neither taking action against her nor removing from the post of Sewika. (ii). For an issuance of writ commanding the respondents to issue order for joining of the
Patna High Court CWJC No.18434 of 2015(2) dt.06-10-2023 2/2 petitioner on the post of Sewika in the view of information received under right to information as well as marks sheet of respondent no.6 which is enough to show that the result was published on 29.6.2007 having marks 56. 86 % (2nd. Division) though selection was made on 22.6.15 and application form was filed on 17.5.07 and subsequently respondent no.6 was selected showing her marks about 86% the facts deals with that the respondents no.6 has committed fraud by submitting forge documents prior to passing the examination and the petitioner having secured 54.11% should have at serial no. 1 in merit list since other highest scorer was outsider from the poshak khestra."

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the District Magistrate, East Champaran at Motihari, for redressal of her aforesaid grievances. Liberty so sought, is granted. 3.
