The petitioner who is in custody since 30.07.2018, has prayed for bail in connection with Masaurhi P.S. Case No. 283 of 2018 registered for the offence punishable under Sections 302 and 34 of the Indian Penal Code.
It is alleged that as a result of family altercation, the petitioner's husband caught hold of the informant's husband and took him out of the house. The petitioner also followed her husband with a Khanti in her hand. Thereafter, it is further alleged that there was hue and cry that the informant's husband had been killed. On the informant reaching near her husband, she saw him bleeding from the back side of his head. As per the submission on behalf of the petitioner, it is
Patna High Court CR. MISC. No.24922 of 2019(4) dt.31-07-2019 2/2 stated that the petitioner is a lady. There is no eye witness to the alleged occurrence. Petitioner has no criminal antecedent and she is in custody since 30.07.2018.
Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, especially the fact that the petitioner is a lady and is in custody since one year, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge, Ist, Patna in S.Tr. No. 702 of 2018 in connection with Masaurhi P.S. Case No. 283 of 2018.
