JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-11-2020 Heard learned counsel for the petitioner and the State. The petitioner is apprehending arrest in connection with Nimchak Bathani P.S. Case No. 176 of 2019 for the offence under Sections 341, 323, 324, 307, 504/34 of the Indian Penal Code.

Allegation against the petitioner is that he along with others have assaulted the informant and her son. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. Learned counsel placing reliance of Annexure-2 submits that the nature of injury is simple.

Considering the fact that petitioner has got no criminal antecedent and Annexure-2 (injury report), the petitioner named above, in the event of arrest or surrender before the court below within one month from the date of

No.26749 of 2020(2) dt.06-11-2020 2/2 communication of the order, is directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-X, Gaya in connection with Nimchak Bathani P.S. Case No. 176 of 2019 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
