Petitioner apprehends his arrest in a case registered for the offence punishable under Section 30 (a), 37(c) of the Bihar Prohibition & Excise Act.
As per the prosecution case, 61 liters of country made liquor has been recovered from motor cycle of co-accused, Guddu Kumar, who disclosed the name of this petitioner. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. No incriminating article has been recovered from the conscious possession of the petitioner and he is no way concerned with the alleged recovery. Petitioner has got clean antecedent.

Considering the facts of the case, nature of accusation and clean antecedent of the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II-cum- Special Judge, Excise Act, Saran, Chapra in connection with Garkha PS case No. 604/ 2021, subject to conditions laid down u/s 438(2) of the Cr.
