The petitioner has preferred this application for grant of regular bail in a case registered under section 413, 414 and 34 of the Indian Penal Code and sections 25(1-B)(a), 26 and 35 of the Arms Act.
As per the prosecution case, it is stated that on search being conducted a looted country-made pistol, stolen motorcycle and mobile phone were recovered from the possession of the petitioner while other articles were recovered from the co-accused.
It is submitted by learned counsel for the petitioner that contrary to the allegation no incriminating article has been recovered from his possession. He is in custody since 22.3.2022
Patna High Court CR. MISC. No.25662 of 2022(4) dt.13-01-2023 2/2 and chargesheet has been submitted in the case. Heard learned APP for the State.
Having heard learned counsel for the parties and taking into consideration the allegation against the petitioner in the FIR, his having remained in custody for 9 months since 22.3.2022 and chargesheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Baniyapur P.S. Case no. 144 of 2022 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra.
