08-11-2016 Heard Sri Bakshi S.R.P.Sinha, learned senior counsel, who was assisted by Sri Lokesh Kumar Singh, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in Jadopur P.S. Case No. 36 of 2015, Trial No. 33 of 2015 registered for offence under Sections 8, 20 and 22 of the Narcotic Drugs & Psychotropic Substances Act, 1985, has prayed for grant of anticipatory bail.

It was submitted by learned senior counsel for the petitioner that only allegation against the petitioner is that he was sitting on a Bolero and from a truck, about 40 kg. of Ganja was recovered. He submits that driver and khalasi of the truck, who

Patna High Court Cr.Misc. No.36729 of 2016 (2) dt.08-11-2016 2/2 were in inimical terms of the petitioner, disclosed the name of petitioner as one of the occupant of the Bolero, who fled away with some quantity of Ganja. He submits that till date the said Bolero has not been recovered and petitioner has falsely been implicated in the present case.

In view of nature of accusation, I do not find any ground to extend the privilege of anticipatory bail. Dismissed.
