The petitioner has preferred this application for grant of regular bail in connection with Narpatganj Police Station (for brevity, PS) Case No 570 of 2022 dated 15.12.2022 registered for the offence punishable under Sections 392 of Indian Penal Code (for brevity, IPC) but charge sheet has been submitted under Sections 395, 397, 412 of IPC.

As per prosecution case, three unknown miscreants

Patna High Court CR. MISC. No.26024 of 2023(2) dt.23-05-2023 2/3 boarded on a motorcycle intercepted the informant's car and looted Rs 40 lakhs from his bag on the point of pistol. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He is not named in the First Information Report. The petitioner is accused in one more criminal case, as stated in paragraph 3 of the bail petition in which he is on bail. He is in custody in this case since 21.12.2022. It is further submitted that the looted article was recovered from the house of maternal uncle of the petitioner.

Learned APP has vehemently opposed the bail petition of the petitioner. He has submitted that the petitioner in his confessional statement has stated the modus operandi as to how the occurrence took place with the association of coaccused persons. Considering the aforesaid facts and circumstances of the case, period of custody as well as the nature of allegation against the petitioner, the petitioner above named is directed to be released on bail on his furnishing bonds of Rs 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in Narpatganj PS Case No 570 of 2022 dated 15.12.2022.
