JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-03-2017 Heard learned counsel for the petitioner.

The petitioner is apprehending his arrest in connection with Gaurichak P.S.Case No. 115 of 2012 registered for the offences punishable under Sections 461 and 379 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that except confessional statement of co-accused there is nothing against the petitioner and there is no recovery from the possession of the petitioner.

Heard learned APP also, who has pointed out that this case is of the year 2012 and further there is criminal antecedent also against the petitioner and he has been made accused in three

Patna High Court Cr.Misc. No.51618 of 2016 (4) dt.28-03-2017 2/2 other cases.

Having heard both sides and in view of nature of offence and criminal antecedent, I am not inclined to grant anticipatory bail to the petitioner.

Let petitioner surrender and pray for regular bail before the court below, who will consider all aspects of the matter as well as the submission of the petitioner and pass an appropriate order, if possible on the say day, without being prejudiced by this order.
