The petitioner apprehends his arrest in a case registered under Sections 379, 411 and 420/34 of the Indian Penal Code.
10 illegal sand laden tractors were seized by the informant. Drivers of the aforesaid tractors managed to escape. Petitioner happens to be driver and owner of the one of the seized tractor.
It is submitted by learned counsel for the petitioner that the petitioner has no concern with the aforesaid occurrence. He was carrying mixed sand and not the illegal sand by his tractor and without appreciating the said fact, informant has seized the tractor of the petitioner. He has no
Patna High Court CR. MISC. No.23791 of 2019(3) dt.17-07-2019 2/2 criminal antecedent. Similarly situated co-accused namely Umesh Kumar has been enlarged on anticipatory bail by a coordinate Bench of this Court vide order dated 16.04.2019 passed in Cr. Misc. No. 24267 of 2019.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Aurangabad in connection with Barun P.S. Case No. 45 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
