The petitioner apprehends his arrest in connection with Madhuban P.S. Case No. 134 of 2015 registered under Sections 363, 364, 367, 374, 120B, 506 and 34 of the Indian Penal Code.
The allegation of informant is that on 11.05.2015, his son Dinesh Kumar aged about 13 years was grazing goat on the field, fromwhere the petitioner and one Jagvir Prasad, co-villager of the informant, enticed away his son for doing the job at Satharia, District - Varanasi. The informant made query about his son, both showed their ignorance. When the informant asked the petitioner and Jagdish to search his son then his villager Parichan
Patna High Court Cr.Misc. No.44498 of 2016 (2) dt.27-10-2016 2/2 Ram, Ramjanam Rai, Harendra Ram, Ramkali Devi, Basanti Devi and Jiya Lal Prasad made attempt to assault him by abusing. Learned counsel appearing on behalf of the petitioner submits that in fact, the son of the informant moved from his house in connection with job without disclosing to the informant, but due to ulterior motive and village enmity the informant has lodged the present case with false allegation about carrying his son by this petitioner and one Jagvir Prasad, from the field. Further submission is that informant is not the eye witness of carrying of his son from the field.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M.-IV, Motihari, East Champaran in connection with Madhuban P.S. Case No. 134 of 2015, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Rajendra Kumar Mishra, J) Shail/- U T
