The petitioner apprehends his arrest in Thawe P.S. Case No. 09 of 2017 instituted for the offence under Sections 147, 148, 149, 341, 323, 447, 504, 379 and 302 of I.P.C. pending in the Court of Chief Judicial Magistrate, Gopalganj. It is alleged in the written report that this petitioner assaulted the mother of the informant with iron rod over her head on account of which she sustained serious injuries and fell down on the ground. Other accused persons also assaulted her with fists, kicks and bricks.

Case diary has been received in which post mortem report is available at para 99, wherein, the doctor has found lacerated wound on the scalp over right parietal temporal region,

Patna High Court Cr.Misc. No.7338 of 2018 (3) dt.27-03-2018 2/2 which supports the allegation.

Therefore, this court is not inclined to grant anticipatory bail to the petitioner.

Prayer for anticipatory bail of the petitioner stands rejected.

Petitioner may surrender before the Court below and seek regular bail, which shall be considered and disposed off in accordance with law without being prejudiced by this order. (Sanjay Priya, J) shakir/- U
