The petitioner apprehends his arrest in connection with Charpokhari P.S. Case No. 28 of 2017 registered under Sections 341, 323, 447 and 379 of the I.P.C. pending in the Court of A.C.J.M.-II, Bhojpur at Ara.
Submission is that petitioner is innocent and has falsely been implicated in the case. It is also submitted that there is 20 hours delay in lodging the F.I.R. and petitioner has no criminal antecedent.
Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner with submission that there is direct allegation against the petitioner and witnesses have also
Patna High Court Cr.Misc. No.36342 of 2017 (6) dt.08-11-2017 2/2 supported the prosecution case as detailed in several paragraphs of the case diary.
Having considered the facts and circumstances of the case and nature of the allegation, I am not inclined to allow the prayer of the petitioner for anticipatory bail. Accordingly, this application is rejected.
