JUSTICE RAKESH KUMAR ORAL ORDER 24-11-2016 Heard Sri Dinesh Prasad Verma, learned counsel for the petitioners and learned Additional Public Prosecutor . Three petitioners who are mother -in- law , brother of the husband of the informant and father - in- law of the informant have prayed for grant of anticipatory bail in Mahila (Madhepura) P.S. Case No. 27 of 2016 registered for the offence under section 498A, 341, 323, 379/ 34 of the Indian Penal Code . Learned counsel for the petitioners at the very outset by way of placing reliance on an order dated 21.10.2016 passed in the case of husband of the informant Md. Mumtaj submits that the husband has been granted regular bail considering the fact that matter was compromised in between informant / wife and
Patna High Court Cr.Misc. No.48186 of 2016 (2) dt.24-11-2016 2/2 husband . Let it be kept on record.
In view of the fact that husband of the informant had already been released on bail on the ground that compromise has already been taken place in between husband and wife, there is no reason to refuse prayer for grant of anticipatory bail of the present petitioners. Accordingly in the event of arrest or surrender within a period of six weeks from today, let the aforesaid three petitioner Subeda Khatoon , Md. Intaj, Md. Sahid be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Madhepura / concerned court in connection with Mahila ( Madhepura ) P.S. Case No. 27 of 2016 subject to the conditions as contemplated under section 438(2) of the Code of Criminal Procedure .
