The petitioner seeks anticipatory bail in Brahampura P.S. Case No.149 of 2011 instituted for the offences under Sections 364 and 420/34 of the Indian Penal Code.
As per allegation, petitioner and his associates had come to the house of the informant and wanted to know the movement of son of the informant. Again on 27.8.2011 accused persons on different motorcycle came to his house and they forcibly kidnapped the son of the informant. When the informant raised alarm people of locality throng and could catch one person disclosed that he was employed in the Indian Army, later on he was identified as Kailash Kumar who had already been sent to
Patna High Court Cr.Misc. No.41244 of 2017 (2) dt.06-10-2017 jail in kidnapping case. Petitioner escaped from there, claiming that he is working in Imphal. The person was caught claimed to be member of the Indian Army but later on it transpired that he is a veteran in kidnapping and was lodged in jail in another criminal case.
In such view of the matter, this Court is not inclined to enlarge the petitioner on anticipatory bail. Accordingly the prayer for bail is rejected.
