The petitioner seeks bail in Kalyanpur P.S. Case No. 316 of 2020, registered for the offence punishable under Sections 302/34 of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, all the FIR named accused persons including this petitioner abused the husband of informant. It is further alleged that co-accused Ramesh Thakur fired in air and co-accused Alok Kumar @ Nanaki fired upon the chest of husband of informant, as a result of which he died. It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case. Specific allegation of firing is against co-accused Alok Kumar @ Nanaki causing death of informant's husband. So far as, this petitioner

Patna High Court CR. MISC. No.36252 of 2021(2) dt.09-12-2021 2/2 is concerned, this petitioner along with co-accused fired in air. Petitioner claims clean antecedent and he is in custody since 22.01.2021.

Counsel for the informant vehemently opposed the prayer for bail and submitted that petitioner is one of the participants in the alleged occurrence.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Samastipur in connection with Kalyanpur P.S. Case No. 316 of 2020.
