JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-11-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 380, 307 and 120B of the Indian Penal Code.

The prosecution case is that the daughter of the informant namely Seema Praveen was assaulted badly by the accused persons on 26.06.2015 at the in-laws place of the informant's daughter.

It is submitted by learned counsel for the petitioner that maliciously the present case has been lodged for the occurrence of 26.06.2015 at 7-8 pm. whereas the petitioner lodged written report against the husband of the daughter of the informant on 29.06.2015 for making an attempt to ravish petitioner's wife though the case was not registered then ultimately on 24.07.2015,

Patna High Court Cr.Misc. No.45157 of 2015 (2) dt.03-11-2015 2/2 the complaint was filed before the learned court below. The accusation is not specific against the petitioner and statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the delayed lodging of the case, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Purnea in connection with Baisi P.S. Case No.121 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
