The petitioner apprehends his arrest in connection with Ramgargh P.S. Case No. 194 of 2016 registered under Sections 341, 323, 354, 448, 379 and 504/34 of the Indian Penal Code.
The accusation is that, on 08.09.2016, informant Malti Devi along with her mother-in-law was cutting grass in plot no. 114, khata no. 14, which was allotted in their favour, then petitioner along with two others, namely, Kamla Singh and Anil Kumar Singh came armed with lathi, rod and Farsa. At that time, Kamla Singh, caused injury at the head of
mother-in-law of the informant through rod, on which, she fell down and thereafter he put his foot on her chest and pressed her neck. When the informant rushed to save her mother-in-law then Anil caused Farsa blow at her head. Thereafter, informant ran away to her house then this petitioner entered her house and took cash of Rs.40,000/- and also tried to out rage her modesty.
Learned counsel for the petitioner submits that the injuries caused to the informant and her mother-in-law by Kamla Singh and Anil Kumar Singh are simple in nature. It is further submitted that, in fact, petitioner, who is own brother of Kamla Singh and Anil Kumar Singh and also son-in-law of the informant, has falsely been implicated in this case due to some dispute. It is further submitted that petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Kaimur at Bhabhua, in connection with
Ramgargh P.S. Case No. 194 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
