JUSTICE ASHUTOSH KUMAR ORAL ORDER 10-11-2020 Heard Mr. Kedar Jha, learned counsel for the petitioners and Ms. Anita Kumari, learned APP for the State. The petitioner seeks bail in connection with Mahila P.S. Case No. 102 of 2019 dated 30.12.2019 instituted for the offences under Sections 376/354(B)/354(C)/34 of the Indian Penal Code.

From the perusal of the First Information Report, it appears that the petitioners have not been alleged to have subjected the prosecutrix to any sexual intercourse. About the petitioners, it has been submitted that because of some dispute with respect to delivery of chicken, the petitioners

Patna High Court CR. MISC. No.27023 of 2020(3) dt.10-11-2020 2/2 had gone against the entire family and three sisters of the prosecutrix were harassed and troubled by them. Learned counsel for for the petitioners has taken this court to the entire bail petition in which the reasons have been assigned for falsely implicating the petitioners. The petitioners are in custody since 01.01.2020. Chargesheet in this case has already been submitted and one of the accused persons, namely, Mukesh Sharma has been granted bail by a Bench of this Court in Criminal Miscellaneous No. 16882 of 2020.

Regard being had to the afore-stated facts, the petitioners, above named, are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Darbhanga, in connection with Mahila P.S. Case No. 102 of 2019.
