The petitioners are apprehending their arrest in a case registered under Sections 341, 323, 324 and 379/34 of the Indian Penal Code.

Allegation is that the accused persons including the petitioners assaulted the informant by means of farsa and lathi, due to which his right hand was injured and they also snatched away his golden chain worth Rs.32000/- from his neck and Rs.4000/- from his pocket.

It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the

Patna High Court Cr.Misc. No.52334 of 2016 (2) dt.08-12-2016 2/2 petitioners. The petitioners have falsely been implicated in the present case. All sections are bailable except Sections 324 and 379 of the I.P.C.

On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj in connection with Kishanganj P.S. case No.460 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
