Petitioner seeks regular bail in connection with Excise Case No. 108/2021 registered for the offence punishable under Sections 30(a)/56(b) of Bihar Prohibition & Excise Act, 2018. The Excise Officials intercepted a car which was being driven by the petitioner wherefrom 219.600 litres of illicit liquor was recovered.

Learned counsel for the petitioner submits that the petitioner has not committed offence in the manner alleged and he is not the owner of the car. Learned counsel next submits that at the time of seizure of liquor, he was driving the said car at

Learned counsel further submits that petitioner is in custody since 17.02.2021 having no criminal antecedents. Charge-sheet in the matter has also been submitted. Having regard to the submissions made by the parties and taking into consideration the material on record and the fact that the petitioner is in custody since 17.02.2021 having no criminal antecedents and the charge-sheet in the matter has also been submitted, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, VED PRAKASH SINGH @ VED PRAKSH SINGH be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise Act, Gaya in connection with I.A. No.1/2021, CIS No. 108/2021 arising out of Excise Case No. 108/2021.
