2. The accused/petitioner seeks bail in connection with Ghoghardiha P.S. Case No.133 of 2023 registered for the offences punishable under Sections 341, 324, 323, 307, 448 and 302 read with 34 of the Indian Penal Code.

3. The accused/petitioner is named in the FIR and is in custody since 06.01.2024.

4. Allegation against the petitioner is to commit murder of the father of the informant along with other named accused persons in the background of land dispute.

5. It is submitted by learned counsel that as per FIR, several persons alleged to assault the father of

No.24852 of 2025(3) dt.24-07-2025 2/3 informant, where allegation against petitioner is to give a single blow of lathi on head of the deceased father of the informant but, multiple injuries were noticed during postmortem and considering all such aspects, other coaccused persons, namely, Md. Mustafa Alam @ Md. Mustafa, Md. Israfit @ Md. Israfir, Md. Yusuf and Md. Salim were granted bail by different co-ordinate Benches of this Court through Cr. Misc. No.85762 of 2023 dated 23.01.2024 and Cr. Misc. No.24115 of 2025 dated 20.06.2025 respectively. While concluding argument, it is submitted that investigation of this case is already completed, for which, charge-sheet has been submitted and, as such, there is no chances of tampering with the evidence and moreover the petitioner is a man of clean antecedent and matter appears compromised between the parties.

6. Learned APP opposes the prayer for grant of bail to the petitioner.

7. In view of aforesaid factual submissions and by taking note of fact as other co-accused persons, who also alleged to be assaulted the father of the informant by deadly

No.24852 of 2025(3) dt.24-07-2025 3/3 weapons during occurrence were granted bail by different coordinate Benches of this Court, as discussed aforesaid, coupled with the fact that investigation of this case is already completed, where petitioner is in custody since 06.01.2024, having no criminal antecedent, accordingly, the petitioner, above-named, is directed to be released on bail furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class, Jhanjharpur, Madhubani in connection with Ghoghardiha P.S. Case No.133 of 2023, subject to the conditions as laid down under Section 437(3) of the Code of Criminal Procedure (for short 'CrPC')/under Section 480(3) of the Bhartiya Nagrik Suraksha Sanhita (for short 'BNSS').
