2. The petitioner is seeking regular bail in connection with Kotwa P.S. Case No. 447 of 2023 for the offences punishable under Sections 341, 323, 324, 307, 379, 504, 506/34 of the Indian Penal Code.

3. As per prosecution, while the informant went to his land, the accused persons having equipped with different weapons were found cultivating his land. On protest, the accused persons claimed ownership to the land in question and in consequence thereof, all the accused persons attacked on the informant and one Zaffurudin is said to have given garasi blow on the head of the informant, who sustained cut injury on his head and he fell down on the ground. The other accused persons also assaulted him and when the other family members came to rescue him they were also assaulted.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He has further submitted that there is case and counter case. Both the parties have suffered injuries. The injuries are simple in nature. He has further submitted that the petitioner is under custody since 20.02.2024.

5. On the other hand, the learned counsel for the informant has opposed the prayer for bail.

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned CJM, East Champaran at Motihari in connection with Kotwa P.S. Case No. 447 of 2023, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
