Patna High Court Cr.Misc. No.21238 of 2017 (3) dt.13-07-2017 2/3 State.

The petitioners apprehend their arrest in a case registered for the offence under Sections 419, 420, 467, 468, 471, 464, 279, 120(B)/34 of the Indian Penal Code and Section 27(a) of the Drugs and Cosmetics Act, 1940.

The F.I.R. was lodged against 17 persons for running illegal clinic / nursing home / pathology lab in the different name and style in absence of proper and necessary qualification. Learned counsel submits that petitioner Ashok Kumar Singh of Cr. Misc. No. 21174 of 2017 has necessary degree of Homeopath. Petitioner Niraj Kumar Singh @ Niraj Kumar of Cr. Misc. No. 21238 of 2017 is running chemist shop and petitioner Bijendra Prasad Sah of Cr. Misc. No. 21089 of 2017 keeps only first aid equipment. Learned counsel further submits that co-accused Raghunandan Sardar with similar allegation has been granted anticipatory bail by this Court vide order dated 01.07.2017 passed in Cr. Misc. No. 24010 of 2017.
