JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-11-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 498A, 504, 34 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.

The basic accusation is of torture for nonfulfilment of dowry demand. It is submitted by learned counsel for the petitioner that petitioner admits his marriage with the informant and is ready to keep the informant with dignity and honour. A statement to that effect has been made in para 6 of the petition which reads as follows:- "That the petitioner is husband of the informant and ready to keep the informant with full dignity and honour."

It is further submitted that similar was the

Patna High Court Cr.Misc. No.52487 of 2015 (2) dt.09-11-2015 2/2 stand before learned Court below but informant refused to reside with the petitioner which gets reflected from the impugned order. The relevant portion of which reads as follows:- "Both the petitioner and informant appeared before this Court and on query, the petitioner is ready to keep the informant but the informant flatly refused to live with the petitioner saying that she has apprehension of assault again and again at the hands of the petitioner..........." It is also submitted that informant got employed as ANM in the Health Department on 07.07.2015 and thereafter she wanted to desert the petitioner. Hence, the present case was lodged.

Considering the present stand of the petitioner, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Darbhanga in connection with Bishanpur P.S. Case No. 92 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Shageer/- U T
