This application for regular bail arises out of Majorganj P.S. Case No. 103 of 2019, disclosing offence punishable under Sections 414, 272, 273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act, 2016.

The petitioner is custody since 14.01.2020. His prayer for regular bail was earlier rejected by this Court by an order dated 24.09.2020, passed in Cr. Misc. No. 18305 of 2020, with an observation that petitioner shall be at liberty to renew his prayer for bail after six months if, in the meanwhile, there was no substantial progress at the trial.

Patna High Court CR. MISC. No.36148 of 2021(2) dt.04-08-2021 2/2 Allegedly, 2772 litres of Nepali sauffi wine was recovered from a pick-up van when intercepted by the police. The occupants of the vehicle including the driver had managed to flee away, who were subsequently apprehended and identified by local Choukidar.

Be that as it may, considering the petitioner's incarceration and the liberty granted to the petitioner to renew his prayer after six months, this application is allowed. Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned A.D.J.-II cum Special Judge Excise Act, Sitamarhi, in Mejorganj P.S. Case No. 103 of 2019.
