The petitioner apprehends his arrest in a case registered for the offence under Section 304(B) / 34 of the Indian Penal Code.
It is a case of dowry death. Petitioner happens to be father-in-law of the deceased.
It is submitted on behalf of petitioner that thrust of the accusation is against husband of the deceased, who is already in custody and since petitioner is father of main accused, he has been made accused in this case. Petitioner is separate in mess & property and has got no concern with the family affairs of deceased.
Learned Addl. Public Prosecutor vehemently opposed the prayer for bail and submitted that petitioner is named in the
Patna High Court CR. MISC. No.25717 of 2022(2) dt.13-09-2022 2/2 F.I.R. and all the F.I.R. named accused including this petitioner committed the murder of deceased.
However, considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-II, Gaya in connection with Belaganj P.S. Case No. 328 of 2020, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure (Prabhat Kumar Singh, J) anay/- U T
