JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 20-09-2017 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner apprehends his arrest in connection with Saur Bazar P.S. Case No. 74 of 2017, registered for the offences punishable under Sections 341, 323, 324, 307, 385, 504, 506, 379/34 of the Indian Penal Code.

The allegation against the petitioner is that he pointed out three naught and caused threats to the informant to kill him if he would not pay ransom of Rs. 50,000/- within two days and co-accused Manish Kumar assaulted the brother of the informant with farsa causing injury and bleeding. Submission is of false implication and that the allegation against the petitioner is super addition only with a view

Patna High Court Cr.Misc. No.44148 of 2017 (2) dt.20-09-2017 2/2 to give colour to the case, due to land dispute the occurrence has taken place. The allegation under Section 379 of I.P.C. is also super addition and, as such, the petitioner deserves sympathetic consideration.

The learned A.P.P. seriously opposes the prayer of pre-arrest bail.

In the facts and circumstances as stated above, , I am not inclined to grant privilege of pre-arrest bail to him and accordingly his such prayer stands rejected in connection with Saur Bazar P.S. Case No. 74 of 2017, pending in the Court of learned Chief Judicial Magistrate, Saharsa.
