The petitioner is apprehending his arrest in a case registered under Sections 498(A), 376, 511, 323 and 506/34 of the Indian Penal Code.
The prosecution case, in brief, is that the informant was married with the petitioner on 27.9.2014. After marriage informant went to her Sasural and enjoyed her conjugal life about 1 1⁄2 years happily. Thereafter her in-laws abused and assaulted her because she did not born any child. Her Dewar tried to make physical relationship with her. The accused persons also demanded dowry of Rs.1,50,000/-.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of
Patna High Court Cr.Misc. No.1162 of 2017 (2) dt.16-01-2017 2/2 tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The allegation of physical abuse has been made against the other coaccused. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Katihar in connection with Mahila P.S. case No.98 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
