BAJANTHRI ORAL JUDGMENT Date : 20-04-2022 Heard learned counsel for respective parties. In the instant petition, petitioner has prayed for the following reliefs:- "For issuance of a Writ of Certiorari for quashing the order of dismissal issued vide Memo No. 1073 dated 13.03.2018passed by Senior Superintendent of Police, Bhagalpur whereby and whereunder the petitioner has been dismissed from the post of constable,inter alia, the following reliefs:- (i). The Appellate Order dated 18.05.2018issued under Memo No. 517 passed by Dy. Inspector General of Police, Eastern Zone, Bhagalpur be set-aside.

(ii). The Order dated 05.03.2019passed by the DGP, Bihar be setaside,whereby and whereunder the Appeal

Patna High Court CWJC No.11001 of 2019 dt.20-04-2022 2/2 memorial prepared by the Petitioner has been erroneously and arbitrarily rejected.

(iii). Respondent Authorities be directed to reinstate the Petitioner on the post of constable with all consequential benefits." Learned counsel for the petitioner submitted that the present petition is covered by the decision in CWJC No. 11097 of 2019 decided on 13.12.2021.

Learned counsel for the State has not disputed the fact that the present petition is squarely covered by the aforesaid decision. Accordingly, the present petition stands allowed in terms of the judgment dated 13.12.2021 passed in CWJC No. 11097 of 2019 and the impugned orders dated 18.05.2018 (Anneuxre-10) and 05.03.2019 (Anneuxre-12) stands set aside.
