2. The petitioner is apprehending arrest in connection with Sono P.S. Case No. 17 of 2025 instituted under Sections 310(2) and 317(1) of Bharatiya Nyaya Sanhita lodged on 21.01.2025 by the informant, Ramji Paswan.

3. As per the prosecution story, the informant alleged that three boys reserved e-Rickshaw from the Jhajha station to Raghunath village for Rs.200/-. As the e-Rickshaw the place, two motorcycles parked there, they made the vehicle stopped, assaulted and took away mobile, the battery as also cash. This led to the FIR.

4. Subsequently, during investigation, one of the passenger Badal Kumar was picked up who made confession and this resulted into the recovery of battery of the e-Rickshaw

Patna High Court CR. MISC. No.26786 of 2025(2) dt.14-05-2025 2/2 as also the mobile phone. The said Badal Kumar named this petitioner which led to his implication.

5. Learned counsel for the petitioner submits that admittedly nothing has been recovered from his conscious possession, he has no criminal antecedent and only on the confession of Sujit Kumar, the name has cropped up.

Learned APP opposes the prayer submitting that after the assault and snatching of the amount/mobile/battery of e-Rickshaw, one of the passenger was apprehended which led to Sujit and Abhishek and recovery. They have named this petitioner and as such he cannot exonerate himself from the alleged act.

7. Considering the submissions of the parties as also the fact that his name has come, a poor person taking out an eRickshaw and going for his solo drive for Rs.200/-, the loot took place, the petitioner's role has also come in the investigation, in that background, no relief can be extended.
