JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-07-2019 This is an application for grant of anticipatory bail in connection with Sursand P.S. Case No.99 of 2012, disclosing offences under Sections 147, 148, 149, 427, 341, 323, 324, 307, 504 of the Indian Penal Code.

Allegation as per F.I.R. against the petitioners is of assault to the informant and others.

Submission of the learned counsel for the petitioners is that they have granted protection by the police under Section 4(1) of Cr.P.C. and on submission of charge sheet, cognizance has been taken after six years.

Patna High Court CR. MISC. No.26122 of 2019(3) dt.05-07-2019 2/2 Heard learned A.P.P. also who has opposed the prayer for bail stating that they have already given police protection. Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner, above named, surrender before the learned court below on 16.07.2019 and on surrender, he will be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned S.D.J.M., Pupri at Sitamarhi, in connection with Sursand P.S. Case No.99 of 2012, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
