JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 10-04-2018 Supplementary affidavit has been filed on behalf of the petitioner. Let it be kept on the record. Heard the learned counsel for the petitioner, the learned A.P.P. for the State as also the learned counsel for the informant.

In this application for anticipatory bail the petitioner apprehends his arrest in connection with Sasaram Town P.S. Case No. 1940 of 2017 for the offences punishable under sections 147, 148, 149, 323, 324, 307, 379, 504 and 506 of the I.P.C. Allegedly, in the occurrence the petitioner gave knife blow in the stomach of Naushad Khan causing injury and bleeding and he fell down.

Patna High Court Cr.Misc. No.17107 of 2018 (2) dt.10-04-2018 2/2 Submission is of false implication and that there is case and counter case, the petitioner has also received injury, copy of which is attached in the supplementary affidavit, there was no intention to commit murder, there is no allegation of repeating the blow and as such the petitioner deserves sympathetic consideration.

The learned A.P.P. duly assisted by the learned counsel for the informant opposes prayer for pre-arrest bail of the petitioner by submitting that grievous injury has been found on the person of Naushad Khan.

In the facts and circumstances stated above, I am not inclined to grant privilege of pre-arrest bail to the petitioner and accordingly his such prayer stands rejected in connection with the aforementioned case pending in the court of C.J.M, Sasaram. (Jitendra Mohan Sharma, J) Abhay/- U T
