JUSTICE MOHIT KUMAR SHAH) 20-09-2025 A letter dated 19.01.2024 has been received from the learned Court of District and Sessions Judge, Rohtas at Sasaram, wherein it has been stated that all the appellants of the aforesaid appeal, namely (1) Raj Deo Singh, (2) Ramjee Singh, (3) Ramayan Singh, and (4) Hari Har Singh have died and in support thereof a report of the Superintendent of Police, Rohtas dated 15.01.2024 has been annexed, with which a letter of the Sub-Inspector of Police, Dehri Muffasil Thana, Rohtas dated 09.01.2024 has been annexed, wherein it has been stated that all the four appellants have died. We find from the records that a certificate issued by the Ward Member, Ward No. 5, Gram Panchayat, Patpura,

Patna High Court CR. APP (DB) No.540 of 1996(7) dt.20-09-2025 2/2 Block-Dehri (Rohtas) dated 11.01.2024 has been annexed to the letter dated 15.01.2024 sent by the Superintendent of Police, Rohtas, wherein it has been mentioned that all the four appellants have died about 10 years back. We also find from the letter dated 19.01.2024 sent by the District and Sessions Judge, Rohtas at Sasaram that notice was sent directly to the aforesaid appellants by the learned Civil Court, whereafter the service report was submitted by the Nazir of the Civil Court, Sasaram (Rohtas) vide letter dated 04.01.2024 and on perusal of the said reports it appears that all the aforesaid appellants have died. 2.

We have no reason to disbelieve the aforesaid fact pertaining to death of the aforesaid appellants, hence the present appeal stands abated as a whole inasmuch as all the appellants have died during the pendency of the present appeal. 3.

Let the records of the aforesaid appeal be consigned to the records.
