JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 28-09-2016 Seen the report submitted by learned District and Sessions Judge, (retired) in pursuance of the order dated 9th August 2016, whereunder the disclosure having been made at his end while disposing of the prayer made on behalf of accused had taken note of relating to the letter no. 4344 of 2012 addressed to the court by the jail Superintendent, Beur.

After going through the content of the report along with annexure, it is evident that the doctors attached with Beur jail had examined under trial prisoner Vijay Prakash, and during course thereof, age of the under trial prisoner shown as 22 years has been incorporated and so, the aforesaid District and Sessions Judge has submitted that on account of some sort of wrong perception during course of scrutiny of aforesaid letter, he opined like so. Furthermore, it has been averred that only to that extent was taken note of, and for which tenders unqualified apology.

Patna High Court CR. REV. No.437 of 2014 (14) dt.28-09-2016 2/2 That being so, the show cause submitted by concerned District and Sessions Judge, is accepted more particularly in the back ground of the fact that he had already superannuated.
