The petitioner apprehends his arrest in Excise Case No. 62/2016, registered for the offences punishable under Section 47(A) of the Bihar Excise Act.
The Sub-Inspector Excise, Rohtas alleged that petitioner was running a liquor shop and seeing the Excise officials he fled away. 500 litres of country-made liquor were recovered from the shop of the petitioner.
Learned counsel for the petitioner submits that the petitioner is not the owner of the shop, but from the enquiry report it appears that when the Excise officials raided the shop, the
Patna High Court Cr.Misc. No.39938 of 2016 (4) dt.28-10-2016 2/2 petitioner managed to flee away and from that place country-made liquor was recovered.
Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
