JUSTICE SANJAY PRIYA ORAL ORDER 23-03-2018 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Chautham P.S. Case No. 182 of 2017 instituted for the offence under Sections 406, 409, 420, 467, 468, 471 and 34 of the Indian Penal Code.

It is alleged in the written report that this petitioner being the Panchayat Secaretary has withdrawn Rs.3,28,000/- of 13th Finance Commission and has misappropriated the amount. The report of Sub Divisional Officer, Khagaria has been enclosed with the written report wherein the Sub Divisional Officer, Khagaria, has found irregularities by the petitioner in construction of Angan Bari Kendra. It is also mentioned in the written report that the petitioner was found making construction of Angan Bari

Patna High Court Cr.Misc. No.9035 of 2018 (3) dt.23-03-2018 2/2 Kendra on some other land in stead of making construction of Angan Bari Kendra on proposed land.

Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.

Prayer for anticipatory bail of the petitioner stands rejected.
