The petitioners seek pre-arrest bail in connection with Katihar (Mufassil) P.S. Case No.71 of 2015 registered under Sections 341, 323, 307, 379 and 504 of the Indian Penal Code. It is contended that though there is allegation against altogether twelve named accused persons, the injury report of the informant as contained in annexure-2 would show that the injured
Patna High Court Cr.Misc. No.53998 of 2015 (2) dt.09-12-2015 2/2 had received only one grievous injury. It is further contended that a large number of persons have been implicated in a false case out of land dispute existing from before. One of the accused, namely, Badrul Doza @ Badrul Razza having more or less similar allegation has already been granted anticipatory bail by a Bench of this Court vide order dated 2.11.2015 passed in Cr. Misc. No.45931 of 2015 Regard being had to the facts and circumstances of the case, in the event of arrest or surrender in the court below within four weeks from today, the above named petitioners are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sri S.K.Sharma, Judicial Magistrate, 1st Class, Katihar in connection with Katihar (Mufassil) P.S. Case No.71 of 2015 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
