JUSTICE MOHIT KUMAR SHAH ORAL ORDER 18-08-2022 Though the present writ petition has been filed seeking a direction upon the respondent no. 5 i.e. Circle Officer, Karakat, Rohtas, Bihar to remove the encroachment from public road situated at Gali (Road) No. 725 beside Mauza-Badd, Thana No. 665, Khata No. 65, Survey Plot No. 726, District-Rohtas, but the learned counsel for the petitioner has restricted his prayer to grant of liberty to the petitioner to approach the respondent no. 5 for redressal of his aforesaid grievance. Liberty so sought is granted.

Patna High Court CWJC No.7115 of 2022(2) dt.18-08-2022 2/2 It is needless to state that in case appropriate petition is filed by the petitioner before the respondent no. 5 under the provisions of the Bihar Public Land Encroachment Act, 1956, within a period of four weeks from today, the respondent no. 5 shall consider the same and pass appropriate orders thereon, after hearing the affected parties and in accordance with law, within a period of 12 weeks, thereafter.

The writ petition stands disposed off on the aforesaid terms.
