2. The petitioner seeks bail in connection with Amarpur P.S. Case No. 768 of 2024 instituted for the offence under Sections 310(4), 310(5) of the Bharatiya Nyaya Sanhita, 2023 and Sections 25(1-b)a, 26 & 35 of the Arms Act.

3. As per the prosecution case, police acting on a tip off, regarding assembly on anti-social elements, conducted raid and apprehended two accused persons with some cartridges and a country made pistol.

4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. petitioner has not been arrested from the spot. No incriminating article has been recovered from the conscious possession of the petitioner. Charge sheet has already been filed. Petitioner is in custody since 29.12.2024.

5. Learned counsel for the State and informant oppose the prayer for bail.

6. Considering the period of custody, prayer for regular bail of the petitioner is allowed. Let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge V, Banka in Amarpur Police Station Case No. 768 of 2024/GR No. 3897 of 2024.
