JUSTICE RAKESH KUMAR ORAL ORDER 21-09-2017 Heard Sri Surendra Kumar Mishra, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in Special Case No. 1424 of 2017 (arising out of Bhagwanganj P.S. Case No. 19 of 2017) registered for offence under Section 30 (a) (b) (c) of Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail in the event of his arrest or surrender. In the present case, huge quantity of Indian make foreign liquor was recovered from a pick-up van as well as a truck and driver of the truck namely Jaswant Singh, who was from Punjab, disclosed that he had carried the said seized liquor, as per instruction of the petitioner.

Learned counsel for the petitioner submits that petitioner is having clean antecedent and he has falsely been

Considering the fact that petitioner's name has come on the basis of confession made by an accused, who was a resident of Punjab, the Court is of the opinion that it is not a case for extending the privilege of anticipatory bail. Dismissed.
