====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 11-11-2020 Heard counsel for the petitioner and counsel appearing on behalf of the State.

The petitioner is apprehending arrest in connection with Vishnupad P.S. Case No. 76 of 2017 for offences under Section 420 IPC.

Allegation against the petitioner is that he has issued rent receipt in relation to the land which was a government land.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. The informant purchased the land from one Sohan Tatwa, who after constructing house, paying house tax and later on it transpired that the land is government land and as such the construction

Patna High Court CR. MISC. No.26824 of 2020(2) dt.11-11-2020 2/2 was demolished. In the aforesaid background the present case has been registered and the petitioner has been made accused. Considering the totality of the fact situation, the Court is inclined to grant bail to the petitioner subject to deposit of Cash of Rs. 50,000/-. Let the petitioner, above named, in the event of arrest or surrender within four weeks from the date of communication of the order, be released on bail on furnishing bail bond of Rs. 50,000/- (Fifty Thousand) with two sureties of the like amount each to the satisfaction of the CJM, Gaya in connection with Vishnupad P.S. Case No. 76 of 2017, subject to deposit of cash of Rs. 50,000/- and further subject to the conditions as laid down under Section 438(2) Cr. P. C. The deposit of Rs. 50,000/- cash shall abide by the final outcome of the pending criminal case.
