JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-10-2016 Heard learned counsels for the petitioners and the State. The petitioners being parents and sister of the husband of the informant are apprehending arrest in a case registered for the offences punishable under Sections 341,323,307,498A and 504/34 of the Indian Penal Code.

The prosecution case is that on 6.8.2016 at 9.30 P.M. the informant was sitting in front of the kitchen, in the meantime, the inlaws including the petitioners came when petitioner no. 3 pulled the informant after catching hold of her hair, petitioner no. 1 poured kerosene oil on the whole body of the informant and petitioner no. 1 asked his wife (petitioner no. 2) to lit the fire,

Patna High Court Cr.Misc. No.42827 of 2016 (2) dt.20-10-2016 2/2 thereafter the informant after raising alarm escaped from the scene.

It is submitted by the learned counsel for the petitioners that admittedly as per the informant no injury was caused to the informant. The accusation has been levelled in the background of property dispute as a result the informant has not made her husband as accused.

Considering the nature of accusation where it is not claimed by the informant that any injury was caused, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Saran at Chapra in connection with Garkha P.S. Case No.238 of 2016 subject to the conditions as laid down under Section 438(2) Cr.P.C.
