The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 307, 380, 448 and 504 of the Indian Penal Code. The prosecution case is that on protest being made by the informant for abusing him, the accused persons assaulted the informant when informant's younger brother, Bhola Prasad, came to rescue he was also assaulted by the accused persons. It is
Patna High Court Cr.Misc. No.54937 of 2015 (2) dt.04-12-2015 2/2 alleged that accused persons damaged the household articles and took away Rs.2500/- kept in a box.
It is submitted by learned counsel for the petitioners that injuries of the informant and his brother have been found to be simple in nature. The petitioners' side, at earlier point of time, lodged Rajauli P.S. Case No.56 of 2015 against the informant and others, wherein petitioners' side have also received injuries. Considering the case lodged by the petitioners' side at earlier point of time, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Nawada in connection with Rajauli P.S. Case No.57 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
