1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in a case registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Amendment Act, 2022.

3. Learned counsel for the petitioner submits that petitioner has antecedent of one case under the Excise Act and allegation is of recovery of 1089 litres of liquor from a pick up vehicle. It is next submitted that petitioner is not owner of the seized vehicle but then came to be implicated in the case on the ground that he was apprehended from the spot. It is further submitted that when checking was going on, petitioner was coming from the same area, when he came to be implicated. It is next submitted that petitioner is in custody since 15.06.2024.

4. Learned A.P.P. opposes the prayer for bail of the petitioner.

5. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, is directed to be released on bail on furnishing bail bonds of Rs.5000/- (Rupees five thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Bhairavsthan P.S. Case No.62 of 2024.
