JUSTICE RAJEEV RANJAN PRASAD ORAL JUDGMENT Date: 16-10-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioners, in the present case, is seeking quashing of the order dated 13.02.2014 passed by learned Chief Judicial Magistrate, Saran in Janta Bazar P.S. Case No. 32/2010 in which learned Chief Judicial Magistrate, Saran has taken cognizance of the offence under Section 457 and 380 of the Indian Penal Code.

Learned counsel for the petitioners submits that it is a case of civil dispute, but on perusal of the records, it appears that there are allegations against the petitioners

Patna High Court Cr.Misc. No.49620 of 2014 dt.16-10-2017 of breaking up the lock of the house of the informant while he was away. There are also allegation that the accused petitioners took away cash, cloths and some documents. After investigation, police has charge-sheeted the petitioners and the learned Magistrate has taken cognizance in view of the materials collected by the police, there is no illegality or infirmity in the impugned order.

This application is, accordingly, dismissed.
