Mr. Madan Mohan, AC to SC 05 ====================================================== CORAM: HONOURABLE JUSTICE SMT. ANJANA MISHRA ORAL ORDER 20-11-2017 Heard learned counsel for the petitioner and learned counsel for the Bank.

A show cause has been filed on behalf of the Bank in which a fair offer has been given by the Bank to the petitioner which is noted at paragraph -9 that the maximum rebate has been allowed to the petitioner and after considering the amount due which comes to Rs. 3,12,993/-, the petitioner has now required to pay Rs. 1,56,500/- in round figure within a period of ninety (90) days as has been directed by the Higher Authority of the Bank.

Patna High Court MJC No.3935 of 2014 (9) dt.20-11-2017 2/2 Learned counsel for the petitioner earlier requested for further time apart from the 90 days as has been offered by the Bank.

This Court, however, feels that as a welfare measure, the bank may not charge any further interest and the period for payment of the same may be extended by a period of six months. The petitioner is thus, directed to pay a sum of Rs. 1,56,500/- within a period of six months positively from the date of receipt/production of a copy of this order.

The contempt application stands disposed of.
