JUSTICE SANDEEP KUMAR ORAL ORDER 09-12-2021 Heard Mr. Amir Alam, learned counsel for the petitioner, Mr. Baidhnath Prasad, learned counsel for the Opposite Party No.2 and Mr. Ram Sevak Choudhary, learned counsel for the State. This application, for grant of anticipatory bail, arises out of Complaint Case No. 775C of 2017, disclosing offences under Sections 323, 379, 406, 498A, 504, 506, 120B of the Indian Penal Code.

Both the parties are represented by their lawyers. A joint compromise petition has been filed on behalf of both the parties. In the compromise petition, the petitioner has undertaken to pay Rs.15 lakhs to the Opposite Party No.2 within 15 months. The settlement amount of Rs. 15 lakhs will be paid in monthly instalment, as mentioned in para 5 of the compromise petition.

Let the petitioner, named above, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Danapur, in connection with Complaint Case No. 775C of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

The petitioner shall be granted provisional bail by the Court below and in case any default of payment of installment amount, the bail bond of the petitioner shall be cancelled. The bail shall be confirmed by the Court below after entire amount of Rs. 15 lakhs is paid to the Opposite Party No.2.

With the aforesaid orders and direction, this anticipatory bail is allowed.
